By purchasing or using the MySchool Discount Card™, you are agreeing to the following specific terms and conditions of the Card Agreement. You understand that MySchool® and its subsidiaries and vendors and partners make available online information and services to cardholders of this program ("Cardholders"). By accepting or purchasing the Card, submitting your information and/or using the Card you are indicating that you are 16 years old or older and agree to be bound by this Agreement. If you are over 16, but under 18 you are also indicating that you have received consent from your parent or guardian and they have agreed on your behalf to be bound by all of the terms and conditions in this Agreement. You acknowledge that the Agreement may be modified or terminated at any time. Any changes will appear on this page. It is your responsibility to refer to the Agreement prior to using the Card. You will be deemed to have accepted any change to this Card Agreement if you continue to use the Card after that change has been posted here.

Privacy Policy
This is the MySchool.com.au Privacy Policy, a document which outlines our privacy guarantee on your use of MySchool’s services.

What we do with your information
Firstly, let us assure you that MySchool Australia Promotions does not give your details to unauthorised parties unless you instruct us to do so.

• We don't sell or trade email addresses or personal information.
• We don't send or tolerate SPAM!
• And, we won't send you emails about anything that's not related to the operation of, or special offers on the MySchool website.

MySchool Australia Promotions (hereafter referred to as ‘MySchool®’) is wholly owned by Walkerden Resources Pty Ltd (ACN:106 770 487) which is a Proprietary Limited Company incorporated in Australia. By accepting the terms and conditions of the Privacy Policy set out herein you acknowledge that any agreement you make with MySchool Australia Promotions is an agreement also made with Walkerden Resources Pty Ltd (ACN:106 770 487).

MySchool uses and may disclose your personal information in order to:

1. Provide services to you;
2. Research, develop, administer, protect and improve our services;
3. Instigate proceedings against misuse; and
4. Comply with legal compulsion such as a Court order.

Other than listed in Clause 1, MySchool will not provide any information which you give to us to any other organisation or individual without your express permission.

As part of routine administration, MySchool collects system status information such as login times and help desk records. These are not on-sold or disclosed to others except as required in paragraph 1.

All clients may request access to the personal details collected by MySchool in relation to themselves and the use of the account owned by them.

MySchool wishes to ensure that such details are always correct and up-to-date, and will amend any inaccuracies or changes to details on request.

5. By law, MySchool must retain some client details for a minimum of 5 years. However, MySchool does not retain clients' personal information longer than is necessary for the purposes of compliance with the law and routine administration.

6. If MySchool is ever sold to another organisation, the new owners must also comply with this privacy policy.

7. MySchool keeps client information on controlled facilities which are secured against unauthorised access. Proof of identity will be required before information is released to any person, including the client.

8. MySchool typically communicates with its clients by email, and may send clients a newsletter from time to time. In exceptional circumstances, urgent notifications may also be sent out by email.

9. MySchool is constantly improving and enhancing its services to clients, and may update this privacy policy from time to time. Any changes to the policy will be posted on the MySchool.com.au web site.

Walkerden Resources Pty Ltd (ACN: 106 770 487) is the owner of the registered trademark MYSCHOOL in Class: 36 which includes: Financial brokering; arrangement of financial transactions; school fundraising; financial advisory services; financial consulting; financial information; financial management; financial sponsorship; financial services.

The trademark "MySchool" must not be used without written permission.

MySchool Discount Card™
The MySchool Discount Card™ is a discount card program offered by MySchool® Australia Promotions that seeks to provide Cardholders with savings and benefits offered by participating merchants online and at merchant locations.

1. Eligibility
Members of the community who are 16 years old or older are eligible to purchase the Card. If you are under 18 years old, you must receive consent from your parent or guardian to be eligible.

2. Card Purchase
When you purchase and activate the MySchool Discount Card™, you must provide MySchool® with your name, email address and the name of the school who sent you the card. MySchool® will use this information to create your account and activate your card.

3.Fees
The current retail price of the MySchool Discount Card is $20. The MySchool Discount Card™ is valid for a period of 12 months from the time of purchase, OR, as noted on the expiration date listed on the Card, whichever is the later date.

4. Card Use
Your Card and your Card number are your keys to savings, benefits and services. Carry your Card with you at all times. You must activate your Card to access the complete savings, benefits and services. Visit MySchool.com.au to activate your card. The Card may only be used by the person whose name is printed or signed on the card or their immediate family.

Use of your Card In-store:
You must show your MySchool Discount Card™ before you make a purchase at a participating sponsor. A MySchool® Authorised Merchant has the right to deny a discount if you do not present your Card before payment. Some MySchool® Authorised Merchants will pass your Card through their barcode reader in order to track purchases and use of the Card. They will not use the Card as a form of payment. MySchool only uses this information to track MySchool® Authorised Merchant performance to ultimately offer you better savings.

Use of your Discount Card Online: In order to redeem savings through our online partners you will be asked to enter your Card number either on MySchool.com.au or at the online MySchool® Authorised Merchant’s Web site.

MySchool Australia Promotions and participating MySchool® Authorised Merchants are independent contractors. MySchool Australia Promotions is not liable for any products or services provided by these MySchool® Authorised Merchants.

Any use of the MySchool Discount Card™, or the associated Cardholder benefits and discounts in a manner that violates the rules or regulations of any participating MySchool® Authorised Merchant or online partner is prohibited by this Agreement and is grounds for cancellation of your MySchool Discount Card™. MySchool® reserves the right to cancel your Cardholder rights immediately in the event of such a violation.

5. Expiration and Cancellation
Your Card will expire on the date printed on the back of the card, or 12 months from the date of purchase of your Card, whichever is the later date.

6. Refunds
MySchool® Australia Promotions provides the card to schools for free. The recommended purchase price of $20 is recommended only and the school is not bound to charge this exact figure. The purchase amount is a donation to the school fundraising efforts and is only refundable at the discretion of the school from whom the card was purchased.

7. Lost Cards
If your verified Card is lost or stolen, MySchool® will replace your verified card for a fee of $5. Cards that have not been verified will incur a fee of $20. You can report lost cards by contacting Card Services by sending e-mail to info@myschool.com.au

8. The MySchool.com.au Web site
The MySchool.com.au Web site (the "Site") offers the most up-to-date information on savings and partner benefits offered by participating MySchool® Authorised Merchants. We take reasonable efforts to maintain the currency of our database of MySchool® Authorised Merchants and their discounts. However, MySchool is not responsible for third parties' restrictions or changes to their offers not communicated to MySchool.

When you wish to purchase goods or services online at the Site or at a MySchool® Authorised Merchant’s web site, you will be required to enter your Card number in order to receive the discount. Some MySchool® Authorised Merchants and discounts may not be available in your community. You should contact the MySchool® Authorised Merchant to confirm they offer the discount. Even though MySchool takes efforts to keep the listing of MySchool® Authorised Merchants and savings up to date, MySchool is not responsible for incorrect or incomplete information regarding the MySchool® Authorised Merchant or its discount. You may submit corrections to MySchool® Authorised Merchants or discounts in an email to info@myschool.com.au

The Site may be used to contact the Card Services department. For questions, concerns or suggestions e-mail info@myschool.com.au. In addition, as a Cardholder you agree to be bound by Terms of Use Agreement of the Site.

9. Merchant Disputes
MySchool Australia Promotions is not responsible if a MySchool® Authorised Merchant changes its discount due to new ownership or acquisition. If you have a dispute with a MySchool® Authorised Merchant to report, MySchool will take commercially reasonable efforts to solve the dispute on your behalf.

You may report disputes with MySchool® Authorised Merchants by contacting Card Services. Reports must be submitted and emailed with the following information: merchant name, merchant address, date of purchase, discount denied and purchase information.

MYSCHOOL AUSTRALIA PROMOTIONS AND MYSCHOOL® AUTHORISED MERCHANTS ARE INDEPENDENT CONTRACTORS. MYSCHOOL AUSTRALIA PROMOTIONS IS NOT LIABLE FOR ANY PRODUCTS OR SERVICES PROVIDED BY OR THROUGH ANY SPONSOR OF THE DISCOUNT PROGRAM, OR FOR ANY ERROR, OMISSION OR INACCURACY IN ADVERTISING MATERIAL OR FOR ANYLIABILITY RESULTING DIRECTLY OR INDIRECTLY FROM A PRODUCT OR SERVICE PROVIDED BY ANY SPONSOR OR OTHER THIRD PARTY IN CONNECTION WITH THE DISCOUNT PROGRAM.

E-mail Policy and Communication Preferences
Cardholders have the option to receive MySchool e-mail updates when they order or activate their Cards online. MySchool uses these updates to provide additional savings, special offers, site upgrades, new features, events, promotions and more. You have the option to e-mail us to opt out from receiving these e-mails using the link at the bottom of any promotional e-mail you may receive.

MySchool® reserves the right to e-mail you with information essential to your participation in our program. You have the option to opt-out of e-mails of this nature also.

10. Changes to offers or MySchool® Authorised Merchants.
Offers made available through the Discount Card may change from time to time. MySchoo®l reserves the right in its sole discretion to change the offers and/or participating MySchool® Authorised Merchants at any time without notice. In addition, MySchool® Authorised Merchants may elect to change offers from time to time without notice. For a listing of current offers, Cardholders should visit www.myschool.com.au If you become aware of a discontinued offer listed, please notify MySchool® by sending an e-mail to info@myschool.com.au or contacting MySchool® on (02) 9825 1234. MySchool® undertakes no obligation to provide a replacement or substitute offer for any offer discontinued.

Privacy
By using the MySchool Discount Card™ you acknowledge that any information we receive from or about you through the Card will be treated according to our Privacy Policy.
