I would like feedback on what rights I have and how I can approach an issue in regards to school fees. I paid 2011 school fees in full in November 2010, I was entitled to a 50% discount as a staff member, after 8.5 years I resigned in December, accepting a Government position.
The school has now requested that I pay the discount back and have sent an invoice, I have written a letter to the principle asking for his confirmation on the matter, he has replied in writing quoting, “It is College policy that only current members of staff are eligible for fee remission and that such fee remission is only applicable during an employee’s time of service at the College and is regardless of the date at which any payment is made.” My letter asked for if there is a policy endorsed by the board which does not allow a staff member to pay in advance.
They have requested that I am liable to pay the balance owing on the invoice.
I was a staff member at the time of making the payment and the College accepted the payment, I have always followed procedures entitling me to the discount, and at no time was I given any advice that I would have to pay back the discount if my employment ceased.
I want to know where I stand and where I can receive help.

I'm not a lawyer and I don't know what the answer is - but I'd suggest they entered into a contract on the basis of your employment at the time. Were there Terms & Conditions as part of that agreement? If so what do they say?

 

I'm not sure but perhaps this matter falls within the jurisdiction of the NSW Ombudsman. Worth making a call to the Ombudsman's office for a chat about it. At the very least, I'm sure they could point you in the right direction.
